Terms of Service

These Terms of Service ("Terms") govern your use of the LIT Homes website and any forms, email lists, and related services we offer online (together, the "Site"). The Site is operated by LIT Homes LLC ("LIT Homes," "we," "us," or "our"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old to submit an application, enquiry, or email sign-up through the Site.

2. Information only; no offer

Content on the Site, including rental listings, availability, pricing, photos, videos, and virtual tours, is provided for general information. It is not an offer to rent, sell, or buy, and it does not create a lease, purchase agreement, or any other contract. Availability and terms can change at any time without notice. A rental is only confirmed once all requirements are completed and approved and a written agreement is signed by both parties.

3. Rental applications and screening

Rental applications, background and credit checks, scheduling, the tenant portal, and payments are handled by third-party providers (currently Zillow Rental Manager, Calendly, and Rentec Direct). Your use of those services is subject to their own terms and privacy policies. Screening is conducted in accordance with the Fair Credit Reporting Act and applicable fair housing laws. If an adverse decision is made based on a consumer report, you will receive the notice required by law.

4. Referral program

• A $100 gift card may be issued to a referring person when a referred applicant lists that person's name, email, and phone number in the "Who referred you?" section of their application, and the referred applicant is approved and moves in.
• One reward per approved tenant household. Self-referrals and referrals of current tenants or existing applicants are not eligible.
• Gift cards have no cash value except where required by law, are issued after approval, and may be subject to the gift card issuer's terms.
• LIT Homes may modify, suspend, or end the referral program at any time, and may decline rewards in cases of fraud or abuse. You are responsible for any taxes that apply to rewards.

5. Selling your property to LIT Homes

When you submit a property enquiry or book a call, you are not obligated to sell, and we are not obligated to make or honor an offer until a written purchase agreement is signed by both parties. LIT Homes acts as a principal buyer on its own behalf. We are not your real estate agent, attorney, tax advisor, or financial advisor, and nothing on the Site is legal, tax, credit, or financial advice. If you are facing foreclosure, bankruptcy, divorce, or probate, we encourage you to consult an independent attorney or HUD-approved housing counselor before signing any agreement. Statements about stopping foreclosure or protecting credit describe possible outcomes, not guarantees. Results depend on your lender, timing, and circumstances.

6. Email communications

If you join our rental list, you agree to receive emails from LIT Homes about available rentals and related updates. Every marketing email includes an unsubscribe link, and you can opt out at any time. We will not send marketing text messages unless you separately give express written consent.

7. Acceptable use

You agree not to submit false or misleading information, impersonate anyone, scrape or harvest data, interfere with the Site's operation, upload malicious code, or use the Site for any unlawful purpose.

8. Intellectual property

The LIT Homes name, logo, photos, videos, text, and design are owned by or licensed to LIT Homes and are protected by copyright and trademark law. You may view and share Site pages for personal, non-commercial use. Any other use requires our written permission.

9. Third-party links and services

The Site links to third-party websites and platforms, including Airbnb, Furnished Finder, Peerspace, Zillow, HotPads, Calendly, Rentec Direct, Instagram, YouTube, and Yelp. We do not control and are not responsible for their content, policies, or practices.

10. Disclaimer of warranties

The Site is provided "as is" and "as available." To the fullest extent permitted by law, LIT Homes disclaims all warranties, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free.

11. Limitation of liability

To the fullest extent permitted by law, LIT Homes and its members, managers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site. Our total liability for any claim relating to the Site will not exceed one hundred dollars ($100). This section does not limit any rights you have under a signed lease or purchase agreement, or under laws that cannot be waived.

12. Indemnification

You agree to indemnify and hold harmless LIT Homes from claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or your violation of these Terms.

13. Governing law

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law rules. Any dispute relating to the Site will be brought in the state or federal courts located in Mecklenburg County, North Carolina, and you consent to their jurisdiction. Matters concerning a specific property are governed by the law of the state where the property is located.

14. Changes

We may update these Terms from time to time. The "Last updated" date above shows when they last changed. Continued use of the Site after changes means you accept the updated Terms.

Privacy Policy

This Privacy Policy explains what personal information LIT Homes collects through the Site, how we use it, and the choices you have.

Information we collect

• Information you give us: your name, email address, phone number, preferred rental area and length of stay, the content of your messages, and property details you share when enquiring about selling.
• Information collected automatically: basic technical data such as IP address, browser type, device type, and pages viewed, which may be collected by our hosting, font, and video providers.
• Browser storage: we save a small value in your browser's local storage so the rental-list pop-up does not keep reappearing. It contains no personal information.

Rental applications, screening reports, and payments are collected directly by our third-party providers, not through this Site.

How we use information

• To respond to enquiries, schedule calls, and process rental or property interest.
• To send rental listings and updates you've asked for.
• To operate, secure, and improve the Site.
• To comply with legal obligations, including fair housing and recordkeeping requirements.

How we share information

We do not sell or rent your personal information. We share it only with service providers who help us run our business (such as email, form-processing, scheduling, property-management, and hosting providers), with trusted property partners if you ask us to connect you with them, when required by law, or as part of a business transfer.

Email marketing

We send marketing emails only to people who sign up. You can unsubscribe at any time using the link in any email or by contacting us. We will honor opt-out requests promptly, and within 10 business days.

Data retention and security

We keep personal information only as long as needed for the purposes above or as required by law. We use reasonable administrative and technical safeguards, but no method of transmission or storage is completely secure.

Children's privacy

The Site is not directed to children under 13, and we do not knowingly collect their personal information. If you believe a child has provided information to us, please contact us and we will delete it.

Your choices and rights

You may ask to access, correct, or delete the personal information we hold about you, or to stop receiving marketing emails, by emailing info@LitHomesLLC.com. Depending on where you live, you may have additional rights under state privacy laws, and we will respond as those laws require. The Site does not currently respond to "Do Not Track" browser signals.

Changes

We may update this Privacy Policy. Material changes will be posted here with a new "Last updated" date.

Refunds & Deposits

Applications, deposits, and bookings

• Application and screening fees are paid to our third-party screening provider and are generally non-refundable once screening has been performed, except where state law requires otherwise.
• Security deposits are held and returned according to your signed agreement and applicable law, including North Carolina's Tenant Security Deposit Act (N.C.G.S. § 42-50 et seq.) and the South Carolina Residential Landlord and Tenant Act (S.C. Code § 27-40-410). Any deductions will be itemized in writing.
• Bookings made through third-party platforms such as Airbnb, Furnished Finder, or Peerspace follow the cancellation and refund policy shown on that platform's listing.
• For any other refund question, contact info@LitHomesLLC.com. Your signed agreement controls if it differs from this summary.
